Fair Use Guidelines

Fair Use, if not fully understood, can get you and PodcastsityTV into trouble. It is understandable that it can be frustrating not to hear back from the actual IP owners. Nonetheless, it is still YOUR RESPONSIBILITY to make sure that legal issues are handled appropriately. Using someone else’s work can lead to severe legal and financial issues for not only PodcastsityTV but you as well. If you’re in any doubt, seek out legal counsel first. PodcastsityTV does not and cannot provide legal counsel.

Key Takeaways for Video Creators:

  • Transformative Use is Key: Aim to use copyrighted material in a way that adds new meaning or purpose.
  • Small Portions Are Safer: When possible, use only short clips or excerpts.
  • No Guarantees: Fair Use is a legal defense, not a right. It’s determined by courts.
  • When in doubt, seek permission: If you are completely unsure if your use of the copyrighted material is Fair Use, ask the copyright holder for permission. It is better to ask for permission. Confirming usage rights is important.

Important Note:

  • Copyright laws vary from country to country. If you’re creating content for a global audience, be aware of the laws in the different regions. Contact a Legal Counsel. PodcastsityTV does not offer Legal Advice.

Okay, let’s break down the term “Fair Use”. We should simply do this. This is especially helpful for someone just starting out making video content.

What is Fair Use?

  • Fair Use is a legal rule. It allows you to use copyrighted material without asking permission from the copyright owner. This is allowed only in certain situations.
  • Think of it as an exception to copyright law. It acknowledges that sometimes, using parts of someone else’s work is necessary for things like creativity, criticism, or education.

Why it Matters for Video Creators:

  • As a video creator, you may want to use a clip from movies, music snippets, or images in your videos. Fair Use helps you understand when you can do that legally.
  • However, it’s very important to know that fair use is not a clear cut thing. It is determined on a case by case basis.

The “Four Factors” of Fair Use:

In the United States, courts look at these four things to decide if your use is “fair”:

  1. The Purpose and Character of Your Use:
    • Are you using the material for something new and different, like a review, parody, or educational video? This is called “transformative” use.
    • Or are you just copying it?
    • Non-profit educational uses tend to have more fair use leeway than commercial uses.
  2. The Nature of the Copyrighted Work:
    • Is the original work factual or creative? Using factual material is generally more likely to be considered fair use.
  3. The Amount and Substantiality of the Portion Used:
    • How much of the original work are you using? Using a small portion is better than using a large portion. Small portion being a short clip vs half of a movie.
    • Even a small portion can be problematic if that small portion is the “heart” of the work.
  4. The Effect of the Use Upon the Potential Market:
    • Are you hurting the copyright owner’s ability to make money from their work?
    • If your use could replace the original work, it’s less likely to be fair use.

How to submit a video for consideration

First, use our “Contact US” form and introduce yourself. Just like a producer/studio, you make your “Pitch” or “Elevator” moment in a description of what your show is about. The site’s EP (Executive Producer/Web master) will determine if your video content is acceptable. This decision is based on the current Channels. You can always suggest a Channel.

Please submit a link to your video, whether on YouTube or another platform, for review. It’s the fastest and easiest way to let us know you’re interested in collaborating.

If you send your contact information, you will be contacted by email.

If the planets align, you will be supplied with dates and times for your premiere !

You will be sent the rental form for the timeslots. The price and duration are spelled out for you. A separate form is a contact form.

Video should be 30 minutes long for a 1/2 hour segment or 60 minutes for a 1-hour segment

The question is always asked: Yes, you can include self-made advertisements within your video segment. Chef/Home Cook cookbooks are a yes; NO if you’re selling supplements.Whatever your niche is, it must match the “sales opportunity.”

Affiliate Marketing. You’ll need to include an FCC Notice. This notice should state that you, the video creator, earn a commission or direct compensation from the sale of items. You will also be required to mention that PodcastsityTV is not responsible for losses and damages. We do not get compensation from the sales made.

You must send the advert or the affiliate ad for approval at the same time as your core video submission due date.

Consequences of submitting Non-Approved Programs: Removal of the video and a warning to the submitter. Permanent ban or suspension of any future submission privileges from the platform for repeated violations.
